Hypnoelp Application

Effective Date: October 22, 2025

These Terms of Service ("Terms") govern your access to and use of the Hypnoelp mobile application ("App") operated by Omelas AI LLC ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Acceptance of Terms

By creating an account, accessing, or using the Hypnoelp App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

3. Eligibility and Age Restrictions

The App is intended for use by individuals who are 18 years of age or older. By using the App, you represent and warrant that you are at least 18 years old.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Your account is personal and non-transferable.

5. Description of Services

Hypnoelp provides hypnosis-based audio content and educational materials designed for recreational and educational purposes, including:

  • Audio hypnosis sessions covering various topics
  • HTML-based workbooks and educational materials
  • Free sample content for evaluation
  • Paid courses available with subscription
  • Optional AI mentoring features

6. Pricing, Payments, and Subscriptions

Current Pricing:

  • Free tier: 4 anxiety sessions + all workbooks forever
  • Premium: $9.95/month for full access + AI mentor
  • Individual courses: $9 each (à la carte)
  • Custom course: $19

All payments are processed through Google Play Store or Apple App Store. Subscriptions auto-renew unless canceled. You can manage subscriptions through your app store account settings.

ALL PURCHASES ARE FINAL. The App provides free sample content to allow evaluation before purchase. By making a purchase, you agree that all sales are final.

7. Content Rights and Modifications

We reserve the right to update, modify, or discontinue any content at any time. Course purchases provide access to the current version of content, which may be updated periodically.

8. Intellectual Property Rights

All content is the exclusive property of Omelas AI LLC or its licensors. You receive a limited, non-exclusive, non-transferable license for personal, non-commercial use only.

Prohibited: Copying, recording, distributing, reverse engineering, or commercial use of any content.

9. User Conduct

You agree to comply with all applicable laws. Prohibited activities include: attempting to access other users' accounts, using the App for illegal purposes, attempting to interfere with the App's operation, or misrepresenting your identity.

10. Medical and Health Disclaimers

THE APP IS FOR RECREATIONAL AND EDUCATIONAL PURPOSES ONLY. It is NOT medical advice, therapy, or treatment. Do not use as a substitute for professional mental health treatment. Consult a healthcare provider for any medical or psychological concerns.

Hypnosis may not be suitable for individuals with epilepsy, psychosis, dissociative disorders, or other conditions. Consult a healthcare provider if you have any concerns.

NEVER use hypnosis audio while driving or operating machinery.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMELAS AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability for any claims shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee specific results from using the App.

13. Indemnification

You agree to indemnify and hold harmless Omelas AI LLC from any claims, losses, damages, liabilities, and expenses arising out of your use of the App or violation of these Terms.

14. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time through the App settings.

15. Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, USA. Any disputes shall be resolved through binding arbitration in Sheridan, Wyoming, except for injunctive relief which may be sought in courts of competent jurisdiction.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or in-app notice at least 30 days in advance. Continued use after changes constitutes acceptance.

17. Service Availability

We do not guarantee uninterrupted availability. The App may be unavailable due to maintenance, updates, or circumstances beyond our control.

18. Data Storage and Loss

Most user data is stored locally on your device. We are not responsible for data loss due to device failure, App deletion, or other causes. Back up important information.
